A Sept. 15 trial date has been set in Kewaunee County Circuit Court for a Denmark teenager charged with first-degree intentional homicide.
Kewaunee County Assistant District Attorney Elma Anderson said the trial for Kent Kuss, 18, is scheduled for that entire week. Anderson, who participated Friday in a status conference over the phone with defense lawyer Russell D. Bohach, said Kuss's final pretrial conference is slated for Sept. 5.
Kuss remains in custody on a $500,000 cash or surety bond. He is accused of fatally shooting Jason Gretzon, 22, of Denmark. The incident allegedly occurred early in the morning of May 19, 2002, near the intersection of County V and Langes Corners Road in the town of Franklin.
Gretzon had exited his vehicle to shoot a handgun at a stop sign, when Kuss allegedly took the handgun away from him and pointed it toward Gretzon's neck before shooting him. Kuss and Gretzon reportedly had been arguing beforehand about whether they should shoot at cows.
Kuss's trial had been set to begin June 2, but Bohach requested a later trial date to allow more time for the defense to investigate the case.
Judge Dennis J. Mleziva is slated Sept. 5 to issue a final ruling on a possible change of venue for Kuss. Anderson said the judge has indicated it is his intent at this point to have jurors selected from Kewaunee County.
Questionnaires have been sent to prospective jurors to determine whether Kuss could receive a fair trial with an in-county jury. The questions were composed with input from the district attorney's office and Bohach.
Anderson said the results of the questionnaires indicate an impartial jury could be selected from among county residents. But she said the people who would be called for jury duty in Kuss's case would be different than the ones who received the questionnaires.
If convicted, Kuss could face life in prison.
