Stealing the Festival Foods Big Cart - a promotional device for the De Pere grocery store - landed a 33-year-old Green Bay man a jail sentence of one year.
Bruce Pirlott was convicted in April of felony theft for paying a man to tow the cart and was sentenced Monday to one year in jail followed by four years of probation.
The criminal complaint said Pirlott told the man the cart needed repairs and asked him to tow it to a service shop in Ashwaubenon. On Dec. 28, Pirlott went to the parking lot of the Ashwaubenon business where the cart was towed and stole $5,000 in parts from the cart.
The complaint said before committing the theft, Pirlott had bragged to his friends about his plans to steal the cart's blower.
Brown County Circuit Court Judge Richard Dietz advised Pirlott on Monday he had committed a serious crime, punishable by up to 15 years imprisonment and $10,000 in fines. Mitigating factors reduced the sentence. Dietz said it was like there were two sides of Pirlott's character.
On one hand, "you can't step back and say I can't do this become I'm going to get in trouble," Dietz said. "The other (side) recognizes that he does have some responsibility to society."
Assistant District Attorney Roger Shaha asked the judge to impose a five-year sentence. He read off a list of Pirlott's previous convictions, which included arson and battery.
But defense attorney Theresa Schmieder said Pirlott was a responsible citizen who worked hard to pay victim restitution for his previous crimes.
Kewaunee County District Attorney Troy Dalebroux testified at the sentencing on the defendant's behalf. He said Pirlott helped detectives with a homicide in Kewaunee County.
"By coming forth with the information he did, he showed me that he's a man with a conscience," Dalebroux said.
