Former Algoma School District administrator Mark Smits is seeking a harassment restraining order against Algoma High School principal Todd LeRoy.
In court documents, Smits accused LeRoy of violating state law on stalking and harassment by "repeatedly maintaining a visual or physical proximity" to him, including when LeRoy moved into a home in Smits' backyard in Luxemburg in May 2002.
Smits also has accused LeRoy of anonymously circulating slanderous materials, twice gaining access to Smits' private office and stealing personal property, damaging and destroying personal property when constructing a rock wall on the border of Smits' land, and numerous other allegations.
"The onslaught of unwanted activity is against my wife and I, however, we have a fear that our children could also be the victims of Mr. LeRoy's unwanted behavior," Smits said. "This behavior serves no legitimate purpose."
Smits has claimed in his request for a restraining order that he fears injury or death from LeRoy, who allegedly told him that "he has a Colt 45 handgun and that he is willing to use it."
Smits was Algoma's superintendent for three years before resigning at the end of the 2002-03 school year to become the Hartford School District's superintendent in southeast Wisconsin.
"I work in a different community and do not have the ability to be home during the week," Smits said. "Hence, without a restraining order, I do not have the ability to protect my family."
When asked last May about his decision to leave the Algoma School District, Smits said it had to do with "pursuing opportunities and determining what was right for me."
But in his request for a restraining order filed Oct. 31, Smits said, "To get away from this individual (Todd LeRoy), I have taken a new job in another community."
Smits also is seeking a restraining order against LeRoy's wife, Sandra, while Smits' wife, Cynthia, is seeking a restraining order against Todd and Sandra LeRoy.
An injunction hearing on Smits' request is scheduled for Wednesday at the Kewaunee County Courthouse before court commissioner William Wolske.
