The city of Algoma has filed suit in Kewaunee County Circuit Court against John Marquardt of JM Construction of Sturgeon Bay for what the city alleges amounted to breaking the contract terms for roofing work.
According to the court complaint, the city awarded JM Construction a $10,120 contract, primarily for roof renovations on a house on First Street, which qualified for home improvement block grant funds.
The contract allegedly called for removing the old roofing material "down to the existing decking," but the existing roof was not removed.
The suit alleges that not removing the old roof will result in "an infirm, structurally impaired and inappropriate structure" and also amounts to a "substantial and significant" breaking of the contract terms.
Along with the city seeking a return of the $10,120 paid to JM Construction, the suit also seeks interest, costs of collection and attorney fees.
The company has been given 45 days to respond to the city's suit.
