A 20-year-old illegal immigrant was arrested Tuesday after allegedly forcing a 13-year-old girl to have sex with him.
Jose A. Murillo-Linares faces a charge of second-degree sexual assault of a child.
According to Capt. Greg Urban, public information officer with the Green Bay Police Department, the girl was at her home in Green Bay on Monday morning when the suspect called her and came over to the house. The victim said she was forced to have intercourse on the couch.
"We don't know why the girl was home that morning," Urban said, adding that she should have been in school.
Urban said the girl and the girl's mother know the suspect.
The case is under investigation. Urban said both the victim and suspect speak limited English.
The suspect made an initial appearance in court at the Brown County Courthouse on Wednesday. Court Commissioner Lawrence Gazeley set bond at $20,000 after denying the suspect's request through a translator that bond be set at $500.
The public defender at Murillo-Linares' side, Suzanne Schairer, had asked for a lower bond because the suspect has no known criminal record, has lived in the area for two years and had 16 years of education in Guanajuato, Mexico.
Gazeley asked the suspect if he knew that if he posted the $500 bond, he could be deported. The suspect indicated through his translator that he understood and still requested the lower bond.
The $20,000 bond was $5,000 below what was requested by the prosecution.
An adjourned initial appearance will take place Oct. 6.
